Custody Evaluators Unfamiliar with Issues of Domestic Abuse

A custody evaluator is a qualified person who analyzes parents involved in Virginia child custody cases. These evaluators can be very useful when courts are determining the best interests of the child, but they may not always know how to address domestic abuse issues.

Domestic violence can be a difficult thing to evaluate and measure, because there are different types of abuse dynamics. For example, violence may be situational, happening as a result of the offender being under an unusual amount of stress at a given time, or it can be an ongoing form of terrorism.

When making decisions about the best custody arrangement, the evaluator needs to determine the type and severity of the abuse that has been in play in a particular family and then make a suggestion regarding what type of parenting plan would be safest and most practical for the children.

Some evaluators may have a hard time differentiating between the types of domestic abuse, and may at times underestimate the severity of the abuse situation. This misunderstanding is usually the result of insufficient training and education.

It’s important for custody evaluators to possess up-to date knowledge about domestic abuse, so that they can make responsible decisions and serve the needs of children in Virginia child custody cases.
