Understanding Grandparents’ Rights in Virginia

June 28, 2011 By HofheimerFamilyLaw

Are you seeking information about grandparents’ rights in Virginia? Grandparents’ rights simply mean that grandparents and other persons of interest can file for visitation rights during Virginia child custody cases.

Grandparents are important people in children’s lives. They provide a special kind of love that differs from the parental connection. Traditionally, grandparents have been seen as the relatives who spoil children with sweets and gifts, but they also pass down family traditions and give youngsters a link to the past.

When a couple gets a divorce and faces a Virginia child custody case, the custody arrangement’s focus is primarily on the parents. However, it makes sense that the child’s grandparents would have the opportunity to pursue legal rights to visitation.

In many cases, the grandparents who apply for visitation are the parents of the non-custodial parent in the Virginia child custody arrangement and are rightfully concerned about how the new situation will affect them.

Virginia family law determines grandparents’ rights to visitation as it would any child custody request. The best interests of the child are considered, and basically, if the grandparent-grandchild relationship is deemed a safe and healthy one, visitation may be granted.

The success of grandparents’ rights issues depends on many details. It’s best to have a Virginia child custody attorney on your side.
