Burden of Virginia Divorce on Pets

Posted on Dec 29, 2011 by Hofheimer Family Law

It’s not uncommon for a couple’s pets to become objects of a dispute over division of property in a Virginia divorce, but it’s the pets’ emotional well-being that should be the first concern.

Though technically pets are considered “property” and the laws of division of property usually apply to them, many pet owners see them as much more than that. In many ways, pets are a part of the family. They bring fun, love and emotional comfort to their owners and are greatly missed when they’re gone. This is why ownership of pets can be such a source of contention.

Many divorce lawyers report that they have seen couples with no children fight over a dog or cat much in the same way as divorcing parents fight over custody of a child. It can be difficult for both pet and owner to face the realities of custody during a Virginia divorce. Although your pet won’t know exactly what’s happening, he or she may very well pick up on your stress and tension and sense that something is amiss.

No matter which partner ends up being granted ownership of your furry friends, you can help provide them with love and stability. For example, you can share “parenting” responsibilities with your ex, such as taking the dog to vet visits. If you’ll be sharing custody of the animal, you might also want to make sure that your pet has toys and other comfort objects at both homes.
